Penalties for Drunk Driving

In Nevada, DUI is a priorable offense. This means the penalties for your second DUI are worse than the first; the penalties for a third are heavier than a second, etc. It’s imperative that you take immediate action in hiring an attorney after your arrest – you only have seven days from when you are arrested to request a DMV hearing.

First DUI Penalties

Up to six months in jail
Up to $1,000 in fines
Alcohol awareness program
If the defendant’s blood alcohol concentration (BAC) exceeded .18%, the court may order an alcohol dependency evaluation and ignition interlock device on the defendant’s vehicle for three years.

Second DUI Penalties

No less than ten days in jail (up to six months)
Up to $1,000 in fines
An alcohol dependency evaluation
Ignition interlock device (up to three years)
License suspension (typically one year)
In addition to these penalties, the court may order participation in an awareness program, such as a Victim Impact Panel.

Third DUI Penalties

Up to six years in prison
Between $2,000 and $5,000 in fines
Alcohol dependency evaluation
Ignition interlock device (up to three years)
Awareness program participation

Felony DUI in Nevada

If your case involves aggravating circumstances, you could face felony DUI accusations. Aggravating circumstances include prior DUI convictions, prior felony DUI convictions, or a serious injury / death linked to the incident.
